mytaxi wins with BEITEN BURKHARDT before Higher Regional Court – Taxi Bonn has to remove anti competitive Clause from its Articles of Association

Frankfurt am Main, 8 June 2017 – The international law firm BEITEN BURKHARDT has scored a victory for the operator of the leading taxi app mytaxi before the Cartel Senate of the Higher Regional Court of Dusseldorf. The taxi cooperative Taxi Bonn e.G. has to change its articles of association.

The below provision which could discourage taxi companies from a cooperation with mytaxi, may no longer be used: "Those who are a member of other radio and telephone systems or other transport service agencies, or work together with such agencies or directly or indirectly or in any other way support them at the same time, to the extent that this has an adverse effect on the cooperative's interests or its operation, may not become a member."

mytaxi was established in 2009. According to company information, the app has more than 10 million downloads and over 100,000 connected taxi drivers in more than 50 cities in nine European countries, which makes it Europe's largest taxi app. mytaxi has over 300 employees and has been part of the Daimler group since September 2014.

The team headed by Frankfurt partner Dr Andreas Lober provided comprehensive advice to the mytaxi app operators on competitive admissibility aspects, having assisted Intelligent Apps GmbH with ongoing legal issues for several years.
